Bus transport concession: persistence does not pay off
As a losing bidder, can you still overturn a transport concession award if new information about the winner – or its bid – emerges after the tender but before operations begin? That was the question before the Trade and Industry Appeals Tribunal (“ CBb ”) in preliminary relief proceedings initiated by Qbuzz B.V. (“ Qbuzz ”). The answer: judicial intervention at this stage is possible, but the threshold is high. For Qbuzz, it was simply too high.
